Compulsory Acquisition / Resumption

It is essential that advice is obtained from a registered valuer. It is not uncommon for real estate taken by compulsory acquisition to be worth more than a layperson might imagine.

In addition to compensation, public authorities are required to pay legal and valuation fees. In most cases they will pay the full amounts. They are also required to pay interest. Some claimants are entitled to re-purchase costs.

Special provisions apply in respect of investment properties and "roll-over" allowances.
